The small print
Terms and legal.
Plain versions first, then the wording that does the work. Buying or using Minium means agreeing to what is on this page.

1. Who you are buying from
Minium is published by Unhallowed Art ("we", "us"). Questions, problems and anything about an order go to this@unhallowedart.com, or through the contact form.
Payment and delivery are handled by our storefront provider, Reflow, and its connected payment processors. Their terms apply to the transaction itself alongside these.
Our store trades as Gloomy Wood Comics, so that is the name that appears on your receipt and on your card or PayPal statement. It is the same business — if you were looking for a charge from Minium or Unhallowed Art, that is the one.
2. What you are buying
In plain terms: one person gets to install and use Minium on the Macs they use, for personal or commercial work, for as long as they like. You cannot resell it or pass copies around.
Your purchase grants a non-exclusive, non-transferable, perpetual licence to install and use Minium for personal or commercial purposes. It does not transfer ownership of the software. You may not redistribute, resell, rent, sublicense, publish or share copies of Minium, nor decompile, disassemble or reverse-engineer it except where applicable law expressly permits that despite this restriction.
3. Your work belongs to you
Anything you make with Minium is entirely yours. We claim no ownership of, and no licence over, the artwork, sprites, sheets, masks or documents you create, and no rights over any game or product you use them in. Minium contains no code that sends your work anywhere — it has no network functionality at all.
4. No warranty
In plain terms: it is a tool made by one person, sold as it is today. We cannot promise it is free of bugs or that it will suit a particular purpose.
To the fullest extent permitted by applicable law, Minium is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that Minium will be uninterrupted, error-free or free of harmful components, that defects will be corrected, or that it will be compatible with any particular hardware, operating system version or third-party software.
5. Limitation of liability
In plain terms: if something goes wrong, the most we can owe you is what you paid. Keep backups of your work — that part is on you.
To the fullest extent permitted by applicable law, neither Unhallowed Art nor its owner, employees or contractors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of data, loss of artwork, loss of profits, loss of revenue, loss of business, loss of goodwill, or cost of substitute software, arising out of or relating to Minium or these terms, whether or not we have been advised of the possibility of such damages and regardless of the theory of liability.
Our total aggregate liability arising out of or relating to Minium or these terms is limited to the amount you actually paid for the licence.
You are responsible for backing up your work. Minium keeps a recovery copy of the open document, but that is a convenience and not a backup system. Do not rely on it as one.
6. Rights this page does not take away
Nothing here excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit us to exclude.
If you bought Minium as a consumer, you may have statutory rights under the consumer law of the country you live in. Those rights stand regardless of anything on this page, and nothing here is intended to affect them. Where a term above is found unenforceable, it is limited to the minimum extent necessary and the rest of these terms continue to apply.
7. Refunds
Minium is a digital download, delivered immediately. If it will not run on your Mac, or it is not what you expected, write to us within 14 days of purchase and we will refund you. There is no form to fill in and no reason required — email this@unhallowedart.com with the address you bought with.
Because the download cannot be returned, we ask that you delete your copy when a refund is issued. Any statutory right of withdrawal you have as a consumer applies in addition to this.
8. Privacy
The application collects nothing. Minium has no network code of any kind. It does not phone home, it carries no analytics and no advertising, and nothing you make in it leaves your machine. Its privacy manifest, which Apple reads, declares exactly that.
This website is static and sets no tracking cookies of its own. Two things do involve other parties:
We do not sell personal data, and we do not share it with anyone beyond what is needed to take payment and deliver the software. To ask what we hold about you, or to have it deleted, email this@unhallowedart.com.
9. Changes
We may update these terms as the software changes. The version in force for your purchase is the one published on the day you bought it, and the date at the top of this page says when it last changed. Continuing to use Minium after a change means accepting the current version.
10. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules, and the courts of that state have non-exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions of the country you live in, or of the right to bring proceedings there.
